Terms of Service

Agreement to Terms

By accessing or using PresenceKit's services, you agree to be bound by these Terms of Service. If you do not agree to these terms, please do not use our services.

Services

PresenceKit provides growth marketing services, including search engine optimisation, AI search visibility (AEO/GEO), local search and Google Business Profile management, review management, content, paid media, website work and analytics, as described in your service agreement.

Engagements

Work is delivered through the following engagements:

• Diagnostic Audit: a fixed-scope, paid engagement covering search, AI answer visibility, local presence, reviews, website conversion and current measurement. Findings are ranked and delivered with a walkthrough call.
• Growth: ongoing work across a single market.
• Scale: ongoing work across multiple locations, markets or service lines.

We do not publish a rate card. Scope and fees are established after the Diagnostic Audit and set out in your service agreement, which governs in the event of any conflict with this page.

AI SEO Visibility Check

The AI SEO Visibility Check is offered free of charge and creates no obligation on either side. Submitting a request does not form a client relationship. Findings are provided as-is and reflect what search engines and AI assistants returned at the time of checking; those outputs change without notice and are outside our control.

Market Exclusivity

Where we have agreed market exclusivity, we will not knowingly take on a directly competing business in the same market for the duration of your engagement. The market and category will be defined in your service agreement. This commitment ends when the engagement does.

Ownership of Work and Accounts

• You own the content, assets and deliverables we produce for you, on payment of the fees due for them.
• Advertising, analytics, search console and business profile accounts are held in your name wherever the platform permits it.
• On termination we will transfer access and provide reasonable assistance in handover. We do not withhold accounts or data as a means of retaining an engagement.
• We retain ownership of our own methods, templates and internal tooling.

Payment Terms

• Payment is due at the beginning of each billing cycle
• Setup fees (if applicable) are due before work begins
• We accept major credit cards and ACH transfers
• Late payments may result in service suspension

Commitment & Cancellation

• The Diagnostic Audit is a one-off engagement with no ongoing commitment attached to it
• Ongoing engagements run month-to-month after any initial period stated in your service agreement
• Cancellation requires 30 days written notice
• Fees for a period already begun are not refunded on a partial basis

Client Responsibilities

You agree to:

• Provide accurate and complete information
• Provide necessary brand assets and content in a timely manner
• Review and approve deliverables within reasonable timeframes
• Maintain accurate contact information
• Comply with all applicable laws and regulations

Intellectual Property

Your Content

You retain ownership of all content, logos, and materials you provide to us. You grant us a license to use these materials to provide our services.

Our Work

Upon full payment, you own the deliverables we create for you, including website designs, content, and graphics. We retain the right to showcase work in our portfolio.

Limitation of Liability

PresenceKit shall not be liable for any indirect, incidental, special, consequential, or punitive damages. Our total liability shall not exceed the amount paid by you in the three months preceding the claim.

No Guarantees

While we strive for excellent results, we cannot guarantee specific rankings, traffic levels, or business outcomes. Digital marketing results vary based on many factors outside our control.

Confidentiality

We will keep your business information confidential and will not share it with third parties except as necessary to provide our services or as required by law.

Termination

Either party may terminate services with 30 days written notice after the initial commitment period. We may terminate immediately for breach of these terms or non-payment.

Modifications

We reserve the right to modify these terms at any time. We will provide notice of material changes. Continued use of our services constitutes acceptance of modified terms.

Governing Law

These terms shall be governed by the laws of the State of Washington, without regard to conflict of law principles.
